The amount of information shared online has increased significantly giving businesses the ability to reach a broader customer base. In digital marketing, consumers enter their personal information to access additional information and/or services such as insurance products. There is an expectation of privacy and security afforded by federal and state laws and regulations to consumers’ online disclosures. Some of the information that consumers enter may be classified as protected health information (PHI). PHI is individually identifiable information such as name, address, date of birth and phone number. While this seems like general information, when provided in a health context or by means that may develop into a healthcare relationship, this same information is protected under the Health Insurance Portability and Accountability Act (HIPAA).
HIPAA is a federal law that requires the creation of national standards to protect sensitive patient health information from being disclosed without the patient’s consent or knowledge. This Privacy Rule ensures that individuals’ health information is properly protected while allowing the flow of health information by covered entities and business associates, which are organizations using or disclosing individually identifiable health information to provide services.
To ensure that consumer information is protected under HIPAA, Digital Market Media, Inc., as a potential business associate, has implemented compliance procedures to ensure that PHI is handled in accordance with corresponding regulations.
